Justices Offer Preview In Drug-Suit Case
WASHINGTON -- Next fall, the Supreme Court will take up cigarettes the controversial issue of whether lawsuits relating to pharmaceuticals are foreclosed by federal regulations. Yesterday, the justices offered a preview of how the high-stakes arguments may unfold.
The court heard a challenge to a Michigan law that shields prescription drug makers from lawsuits claiming injury -- unless a drug maker committed fraud to win approval from the Food and Drug Administration.
The case directly concerns only lawsuits filed in Michigan over the diabetes drug Rezulin, which the maker removed from the market in March 2000 after it was linked to tobacco factory.
